I. SAFETY
JmaWellness, L.L.C.’s classes are “hands on” and we are strongly dedicated to ensuring the safety of all of our participants and ask that you use caution, notify us of any issues, and maintain safety at all times. PARTICIPANT AGREES BY SIGNING THIS AGREEMENT TO ACT TO RELEASE JMaWellness, L.L.C.., IT’S OWNERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL LIABILITY FOR INJURIES AND/OR DAMAGES TO ONE’S PERSON OR PROPERTY INCURRED IN CONNECTION WITH THE CLASS.
II. ATTIRE
Class participants are responsible for their own attire and can bring an apron. Participants are advised to wear an appropriate outfit since they will be a homestead/small farm with uneven terrain and understand that the floor is gravel/lava.
III. PARTICIPANT RESPONSIBILITIES.
Participants are expected to show respect for others, follow directions from teachers and staff, and abide by all rules. Failure to conform to these rules may result in Participant’s dismissal from classes with no refund.
IV. HYGIENE/HAND WASHING
Proper hand washing with soap and warm water is required after using the bathroom, sneezing, coughing, and/or handling products. Proper sanitation will be required during each class!
V. ALLERGIES AND DIETARY RESTRICTIONS
It is the participant’s responsibility to inform JmaWellness, L.L.C., of any allergies or dietary restrictions that participant may have. Information regarding allegies or dietary restrictions must be reported on the JmaWellness, L.L.C. registration form. In the event that Participant learns of a new medical condition, Participant must report it to a JmaWellness, L.L.C. official.
VI. SCHEDULE
JmaWellness, L.L.C., reserves the right to cancel classes at any time and/or for any reason, and provide a full refund if class minimum requirements are not met.
VII. PAYMENT, RESCHEDULING AND CANCELLATION
Payment is due in full at the time of registration. Food cost and instruction are included in the payment. JmaWellness L.L.C, has the right to substitute food items based on availability. Reservations are taken on a first come, first serve basis. NO REFUNDS WILL BE GIVEN FOR MISSED CLASSES.
VIII. PARTICIPANT WAIVER & RELEASE OF LIABILITY
All participants must review, sign and date the attached participant waiver & release of liability agreement.
IX. MEDICAL CONSENT & RELEASE FORM
BY SIGNING THIS AGREEMENT, PARTICIPANT GIVES JmaWellness, L.L.C. PERMISSION FOR MEDICAL TREATMENT TO BE ADMINSTERED BY A MEDICAL PROFESSIONAL IN THE EVENT OF AN EMERGENCY. PARTICIPANT ALSO AUTHORIZES THE STAFF OF JmaWellness, L.L.C.. TO MAKE REASONABLE EFFORTS IN THE BEST INTEREST OF THE PARTICIPANT IN THE EVENT OF AN EMERGENCY. Participants understand that they are required to sign the release of liability form prior to the start of class. By participating they acknowledge and release all liability against JmaWellness LLC and 15-2054 11th Avenue Keaau, HI 96749 knowing they are solely responsible for any and all accidents or injuries.
X. PHOTOGRAPHS AND FILMS
As a method of training, educational tutorials, or promotional material (electronic or printed), and for the purposes of JmaWellness L.L.C.’s website, Instagram, Facebook or other related social media or promotional pages, I hereby grant JmaWellness L.L.C. all rights and consent to use, copy, display, distribute, copyright, re-use, publish or re-publish, all photographs/video of myself or my child taken during the classes, without restriction to duration and without compensation. If you would not like to be videotaped or photographed for any reason, you must notify a JmaWellness, L.L.C. official at the time of registration.
XI. INTELLUCTUAL PROPERTY
All curriculums remain the property of JMaWellness L.L.C. The dissemination of recipes or techniques, the property of JmaWellness L.L.C., is not allowed without the prior written consent of JmaWellness L.L.C. These shall not be used for copying, reproducing or any commercial use. Such unauthorized dissemination, by whatsoever means, may lead to litigation/court proceedings.
XII. GOVERNING LAW
This Agreement shall be controlled by and construed in accordance with the laws of the State of Hawaii.
XIII. SUCCESSORS AND ASSIGNS
Subject to the restrictions set forth herein, this Agreement shall inure to the benefit of and be binding upon the heirs, personal representatives, successors and assigns of the parties.
